Welcome to Melbourne Boat Works Group. By engaging our services or using our website, you agree to the following terms and conditions. These terms protect both you and our technicians to ensure a transparent and professional service experience.

1. Professional Services & Authorisation

Melbourne Boat Works Group provides marine mechanical repairs, maintenance, and diagnostics. By delivering your vessel to us or requesting on-site service, you authorise our technicians to operate the vessel for the purposes of testing, inspection, and delivery.

2. Estimates and Additional Work

• All quotes are estimates based on a preliminary inspection.
• If we discover additional faults or required parts during the repair process, we will pause work and seek your approval before proceeding with extra costs.
• As an Authorised Yamaha Dealer, we use genuine parts where specified. We are not liable for delays caused by third-party shipping or manufacturer backorders.

3. Payment & Worker’s Lien

• Payment is due in full upon completion of the service and prior to the vessel being removed from our care.
• Worker’s Lien: In accordance with Victorian law, Melbourne Boat Works Group maintains a "Particular Lien" over any vessel, trailer, or equipment in our possession. This means we may legally retain possession of your property until all outstanding invoices are paid in full.

4. Storage and Collection

• Vessels must be collected within 48 hours of notification that work is complete.
• Vessels left beyond this period may incur a daily storage fee.
• While your boat is in the d'Albora precinct or our workshop, it is stored at the owner's risk. You must maintain valid comprehensive marine insurance for your vessel at all times.

5. Australian Consumer Law (ACL)

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to:

• Cancel your service contract with us; and
• A refund for the unused portion, or compensation for its reduced value. This guarantee does not apply to damage caused by normal wear and tear, owner negligence, or unauthorised third-party modifications following our service.

6. Limitation of Liability

To the extent permitted by law, Melbourne Boat Works Group is not liable for any indirect, incidental, or consequential loss (such as loss of use of the vessel or loss of profits) resulting from service delays or mechanical failure.

7. Governing Law

These Terms are governed by the laws of Victoria, Australia.
